County BZA Denies S&L Petition
Kosciusko County Board of Zoning Appeals held its regular monthly meeting Tuesday morning in Warsaw. Among the petitions considered were two from S&L Builders on CR 1150 North, west of Camp Mack Road in Van Buren Township.
One petition asked for an exception to allow a multi-family residence and the other asked for a variance to allow the multi-family on an undersized tract of ground, in this case 34,848 square feet, when 50,000 square feet is required.
Both petitions were denied, though, as the BZA felt the tract is too small to support multi-family and is not compatible with the surrounding area.
Also on the agenda, a petition from John Karagiannis for an exception to alter a non-conforming tract of ground on CR 1100 North at the intersection with Turkey Creek Road in Turkey Creek Township was tabled until the Sept. 9 meeting. The intent is to split off a small tract of ground from a larger tract for financial reasons. The BZA wants time to review the paperwork because it is a complicated procedure, noted Matt Sandy, assistant planning director for the county.
Other agenda items included:
• The BZA upheld a 2006 decision and denied a petition by Steven Kelly to allow relief from a negative easement on Sleeping Beauty Lane in Turkey Creek Township.
• Dan Underwood had two petitions denied for property on EMS T49 Lane in Tippecanoe Township. One was for building an oversized accessory building, while the other was for an addition to an existing pole barn. There were remonstrators against the petitions who felt the buildings would not be compatible with the area and would reduce property values.
• Kevin and Dana Pahud were granted an approval to allow a residence and garage to be rebuilt on Ogden Point Road, west of Sunrise in Turkey Creek Township. The buildings must be 10 feet from the right of way and 5 feet from the side property line.
• Peggy Iholtz was granted an exception to separate a body shop from an adjacent residential property on SR 14, west of CR 600E in Jackson Township.
• Keith Reinholt was granted a variance for construction of a residence accessory, a detached open pergola, on Forest Glen Avenue, east of EMS T25 Lane, in Plain Township. Reinholt must get a 10 foot negative building easement from a neighbor, though.
• Kenneth Hale was granted an exception for a home based business, a sawmill, on CR 200W by the railroad in Lake Township. He must present a site plan with fencing and building specifications and the petition will be reviewed one year from now.
• Jameson and Sheena Ringger were granted a variance to build a new single family residence on Ogden Point Road in Turkey Creek Township at 20 feet from the road right of way, not the 12 feet requested.
• David Zipfel was granted a variance to allow a living quarters to remain as is on Highland View Drive, east of Elwood Avenue in Turkey Creek Township.
• Jerry Smith’s petition to allow a shed to remain as placed, as well as a pool and residential fence, on SR 13, north of EMS B8 Lane in Tippecanoe Township, was tabled until the Sept. 9 meeting because his notifications were not done properly.
• Warren Byrd was granted a variance to permit construction of a new residence on Island Avenue in Turkey Creek Township. The main doors of the garage will be 20 feet from the right of way.
• Cara Sills’ petition to allow a new residence on EMS B74 Lane, north of Barbee Road in Tippecanoe Township, was tabled until the October meeting to allow a site plan to be developed and to work with the county health department on sewage requirements.
